		<description>Should tax evasion be criminal? The prosecutors in the Barry case said it was unaceptable to shirk the civic duty of paying taxes.  If the prosecution (which I assume is the Justice Department) says it is a civic duty then the government must consider it a civic duty.  If it is a civic duty, how can it be criminal?  I can think of a lot of things that might be considered a civic duty but you don&#039;t go to jail for not doing them.  Not that I don&#039;t think Marion Barry ought to go to jail, mind you.  Maybe if he goes he can run for the House or the Senate when he gets out and join the rest of the folks who make &quot;honest mistakes&quot; or have other much more important things to do than to pay their taxes such as our esteemed Secretary of the Treasury.</description>
