Ask the taxgirl: Rebates and Ineligible Spouses

by Kelly on June 20th, 2008

Taxpayer asks:

Good Morning Kelly, i have a question about the free goverment money that i did not received.
I have a SS, my son was born here , and my wife does not a have a SS yet… But she does have an Itin Number… I do all the taxes every year for us tree… Do i still receive any money??? If i do i was suppost to received eletronicly, because i did direct deposit on my taxes , and my last digit of my SS is 37… If you say that i still can receive, can you provide me with a phone number that i can contact some one about this…Thank you so much..have a nice day..

Taxgirl says:

Unfortunately, if you filed jointly, you are out of luck. The IRS will not issue a rebate to any taxpayer who files a return (joint or otherwise) when one taxpayer has only an ITIN.

You can find more information about foreign taxpayers on my prior post.

Like any good lawyer, I need to add a disclaimer: Unfortunately, it is impossible to give comprehensive tax advice over the internet, no matter how well researched or written. Before relying on any information given on this site, contact a tax professional to discuss your particular situation.
