IRS Extends Drought Tax Relief for Farmers and Ranchers

This past year has been very dry in many parts of the U.S., which has been particularly devastating for farmers and ranchers. As a result, the IRS has announced additional tax relief for those who were forced to sell or exchange livestock because of drought conditions. Under the guidance, affected taxpayers may take more time to replace their livestock and defer tax on any gains from forced sales or exchanges.

The relief generally applies to livestock held for draft (work animals), dairy, or breeding purposes when conditions forced a farmer or rancher to sell more animals than would ordinarily be sold under normal business practices. To qualify, the sale or exchange must be attributable to the drought, and the affected area must have been designated as eligible for federal assistance.

(Notably, poultry does not qualify, nor do animals raised for slaughter or held for sporting purposes.)

What does the relief look like?

Normally, under section 1033, taxpayers can postpone recognizing gain when property is involuntarily converted, and they purchase qualifying replacement property within a specified period. The usual replacement period is two years, but qualifying weather-related sales of livestock get a longer, four-year replacement period. Congress also authorized the IRS to extend that period further when the drought or other weather conditions persist for more than three years.

That’s what Notice 2026-54 does. Under rules previously established in Notice 2006-82, the replacement period can remain open until the end of the taxpayer’s first tax year ending after the applicable region finally experiences a drought-free year. For this purpose, the IRS looks at the county where the drought-related sale occurred as well as all counties contiguous to it. A year is not considered drought-free if severe, extreme, or exceptional drought was reported anywhere in that region during the 12-month period ending August 31.

For farmers and ranchers whose four-year replacement period was otherwise scheduled to expire at the end of 2026, the new notice means more time to replace livestock if their region includes an area on the IRS list. The relief is not necessarily limited to a single additional year: if qualifying drought conditions persist, the replacement period can be extended until the region experiences a drought-free year.

Where does the relief apply?

The list includes 49 states (the only state not listed is Alaska), the District of Columbia, Puerto Rico, and other areas that reported exceptional, extreme, or severe drought during the 12-month period ending on Aug. 31, 2026. Normally, this is the part where I’d just link to the list, but it is pretty extraordinary. I think the scope is important, so here’s a look.
