If your spouse dies during the year, you have a few filing options. One of your options is to file as married filing jointly during the year, just as always. However, the rules specifically state that you can’t do this if you do something else before the end of the calendar year. What could you do during the year that your spouse dies that would prohibit you from filing jointly with him or her?

I don’t this answers the question, but I found it interesting. I remember reading somewhere that if you do remarry before December 31 of the same tax year you can still file your spouse’s tax return as married filing separately AND you may also file as married with your new spouse.
So according to the IRS you can be married to two people at the same time!
