Tax Trivia: Deceased Spouses

Kelly Phillips ErbJanuary 30, 2010

Update: We have a winner! It’s Paula! For the answer, see the comments!

Our next tax trivia question for the giveaway is:

If your spouse dies during the year, you have a few filing options. One of your options is to file as married filing jointly during the year, just as always. However, the rules specifically state that you can’t do this if you do something else before the end of the calendar year. What could you do during the year that your spouse dies that would prohibit you from filing jointly with him or her?

The first correct answer wins free CCH tax prep software. I’m looking for a specific answer on this one: my answer is final.

Remember that you have to comment on the actual post, not on email, Twitter or Facebook, in order to win (though feel free to comment that way for fun). You can read the rules for the giveaway and more about the prizes here.

What’s your guess?

I don’t this answers the question, but I found it interesting. I remember reading somewhere that if you do remarry before December 31 of the same tax year you can still file your spouse’s tax return as married filing separately AND you may also file as married with your new spouse.

So according to the IRS you can be married to two people at the same time!
