The blogosphere is buzzing this morning about the acquittal of Tommy Cryer, a Louisiana attorney. Tommy Cryer was indicted in October 2006 on tax evasion charges.
Cryer was acquitted by a U.S. District Court jury of failure to file income tax. Prosecutors claimed that Cryer didn’t pay $73,000 of income tax for the taxable years 2000 and 2001. Cryer created a trust to shelter his income and claimed that he did not need to report income paid to the trust. Cryer also popularly claimed that there was no law that required him to file income taxes – an argument that has repeatedly been shot down time after time – including Ed Brown’s recent guilty verdict.
So, what’s different here? My colleague over at Law Prof on the Loose offers some excellent analysis of the case. Specifically, he points out that in a criminal income tax case, “the government has the burden of proving, not only that the defendant didn’t pay his taxes, but that the defendant knew he had to pay his taxes.”
Before you get all excited, you should know that Cryer’s had his share of issues, including an appearance before the bar disciplinary committee for professional neglect. His excuses for his behavior ranged from claiming mental illness to severe financial issues. So, he’s hardly the poster child for an intelligent, well thought out professional tax protest.
Cryer won because he had the truth on his side, and the Judge allowed due process to proceed. The jury, as would any jury, understood the truth. There is no law making one liable for taxes on one’s common labor. That is so difficult for some people to understand about that statement? If there was a law, Tommy Cryer would be in jail.
The Brown’s also had truth on their side but, unfortunately, their Judge did not allow due process to proceed. Their Judge conducted himself in a criminal manner.
Are my following paragraphs correct?
In many of the arguments that the law requires income tax to be paid, there exists phrases like “because the court has found that…”.
They seem to be unaware of the hole in their proof that exists with the possibility of the court finding something incorrect.
It is logically possible for the justices and justices to interpret the constitution wrong. The constitution has a real meaning whether anyone has deciphered it correctly or not.
It does not just mean whatever the justices decide they want it to mean.
The Supreme Court has already ruled on a number of arguments concerning a direct tax of labor. It found that “income” means “gain”. We exchange our labor. We do not “gain”from it. This is as true today as it was throughout our species history. Only the labor of slaves is taxable. Will all the slaves in the room please raise their hand.
Further, the “income tax” laws are found in Title 26 of the United States Code. A thorough reading of that compilation of statutory excerpts, using the language of the underlying statutes as authority of course, reveals that the law as written does not make liable the average man or woman laboring and receiving money in return.
The advent of the computer has allowed what was once a seeming impossible task, i.e. cross-referencing the code for all pertinent liability statutes, to be accomplished in a relatively short period of time by anyone.
The curtain has been pulled back revealing that the wizard is nothing more than a fat, little old man. It is just a matter of a few short years and the IRS, and those working for that criminal agency, will be running for the cracks and crevices or otherwise succumbing to the revenge of an enraged populace.
I don’t want to spend a lot of time on this issue because I think these arguments are both specious and flawed – and have been addressed time after time.
But I will cite to Title 26, the US Tax Code, which is, yes, law (despite many arguments that Code is not law), which states at Section 61:
Except as otherwise provided in this subtitle, gross income means all income from whatever source derived, including (but not limited to)
the following items:
(1) Compensation for services, including fees, commissions, fringe benefits, and similar items;
(2) Gross income derived from business;
(3) Gains derived from dealings in property;
(4) Interest;
(5) Rents;
(6) Royalties;
(7) Dividends;
(8) Alimony and separate maintenance payments;
(9) Annuities;
(10) Income from life insurance and endowment contracts;
(11) Pensions;
(12) Income from discharge of indebtedness;
(13) Distributive share of partnership gross income;
(14) Income in respect of a decedent; and
(15) Income from an interest in an estate or trust.
And at section 63:
Except as provided in subsection (b), for purposes of this subtitle, the term “taxable income” means gross income minus the deductions allowed by this chapter (other than the standard deduction).

What you government sycophants can’t seem to grasp is that the “income tax” is a tax on certain ACTIVITIES that fall under the jurisdiction of the federal government to regulate. The tax is not ON income, per se. Congress did not tax the money earned from the activities, but the activities THEMSELVES. The “income” earned is the MEASURMENT OF THE TAX.
The ACTIVITIES which actually are statutorily taxed are found in the “operative sections” of the Internal Revenue Code in Subchapter N, which is aptly titled “Tax Based on Income from Sources Within or Without the United States.”
There is NO “operative section” describing the activities of the average American, only international and posssessions commerce.
Section 61 is nothing but a broadly worded GENERAL definition statute. It does not establish liability for anyone, including the people for whom the Code DOES establish liability.
Hey Title 26 girl Kelly. That’s great, but not news. You forgot the rest of the law which identifies WHO is responsible for paying taxes on those things. Don’t fall for the old slight of hand “look over here” and don’t read over there. We have been so brainwashed in this country. The ONLY person who may be required to pay a tax on labor is an employer making a profit from an employee. For example an employer pays an employee $12/hr. he bills out that employee’s labor at $50/hr. (let’s say as an electrician) the “income” would be the $50 minus the $12 minus all other expenses such as insurance, vehicles, facilities. If the employer makes $10 / hr. from that employee after all expenses that is income and that is the only way labor could possibly be taxed under the constitution. That is the employer’s “income” would be taxable, never the employee’s. Read the entire Title 26 of the U.S. code, read the constitution, research it but only if you want to know the truth. I guess if you want to be an ignorant IRS criminal or their cheerleader – just believe what you’re told without question.

But seriously, one of the things that annoys me most about the kinds of arguments/commentary put forth by folks like Jason is this notion that those of who follow the law are “ignorant” – I’ve even been called a sheep a couple of times on this blog. As someone who has studied tax law for years in law school, and has practiced as a tax attorney for even more years following that, I hardly consider myself ignorant. I also have great respect for many of my colleagues that have posted interesting, informative and well-researched pieces on tax law for years – the idea that we are merely dupes is laughable.
Apparently, we don’t have the “street cred” that you get from flipping through some tax evasion propaganda on the web and calling it the “truth.” Much of the tax protestor stuff is written by convicted felons and others such as Irwin Schiff (more here: http://www.taxgirl.com/those-tired-arguments-still-dont-work/) who have made money – LOTS of money – selling anti-tax merchandise to folks desperate for some credibility.
And one more thing: I’m not a “cheerleader” for the IRS. In fact, I make my living more or less arguing with the IRS, so I find the criticisms leveled at me in that regard to be pretty funny.
There must be a liability statute. Show it. And please, the “code” is just that – a “code”. The IRS pulled together and arranged statute sections which, on a superficial reading, can give the impression that even a Frenchman working in Paris is liable for the US “Income Tax”. Liability must be imposed in clear and unambiguous language. The Suprme Court has ruled upon that repeatedly.
Also, the Supreme Court has ruled that the definition of income is “gain”. An exchange of one’s labor for something of equal value is not a net gain.
And, yes, “taxable income” can be “derived” from labor.
The constitution was written by men fully aware that only slaves are forced to give the fruit of their labor to their masters. And, if we can be forced to pay tribute at any percent, we can also be forced to pay 100%. Oue benevolent master, the federal government, would, I am sure, provide us with sufficient food, housing, and medical care so as to insure we produce for many years.
The trouble with legal professionals is they are officers of the court. They have a vested interest in maintaining the scam. And, scam it is. Lawyers just cannot seem to grasp that you do not have to go to law school to get an education in tax law.
I would recommend everyone read Dan Meador’s work. I have yet to read an honest rebuttle of the issues he raises. Especially on jurisdictional restrictions on the federal government imposed by the constitution.

It seems to me that when someone bring up this argument, people divide into 2 groups immediately. Those who say “read title 26”, and those who say “we have, and it says we are not liable.”
What we get is and argument with no one really pointing out why title 26 says one is liable. Just pointint one to the tax code is not proof that we have to pay it.
In Kellys post above she does just that. But Kelly, which part specifically says you have to pay? I hate to use a cliche, but “Show me the money!”

Show all of us the money. The code is quite clear about the liability incurred by those who deduct money from a paycheck, and required to send it in to the IRS. However, there is just no place -NONE- in the entire code, imposing a liability upon the money received by a typical worker in the private sector not engaged in “a trade or business”. If you IRS employee wannabees are so darn sure that there is, why not put all of us in place by just showing it. Is that too much to ask?

In fact, they have the entire US Code – all of the laws of the US are codified, not just the Tax Code.
As to your specific question, at Section 1, there is language that says, “There is hereby imposed on the taxable income of–” and then proceeds to cite to the various types of taxpayers such as “every individual… a tax determined in accordance with the following table:” Each type of taxpayer is then specifically called out (married, unmarried, head of household, etc.”
Taxable income is, as mentioned before, defined elsewhere.
It’s also worth checking out the procedural side of the law, specifically at section 6012 which spells out who is required to file a return. Again, the section will refer you to other places in the Code.
One of the reasons that it is perceived that there is “no tax” is that the sections of the Code are kind of like a road map. One points to you another. This is hardly specific to tax. The laws governing everything from murder (lots of different kinds of homicide, manslaughter, etc.) to traffic laws are similarly written. It’s maddening, I know, but there are few straightforward, plain language laws because our government is saddled with the task of not only writing laws but proactively answering the challenges to the bill.
Carl, as to your statement, I would refer you to the same sections. Income is not restricted to a paycheck – independent contractors and other small businesses clearly meet the criteria of “gross income” and “taxable income” (which have already been cited). Nowhere does it exclude private funds not received as trade or business – except for those funds that are clearly exempted as a gift or inheritance (the onus is on the donor/decedent in those cases).
You can peruse the statutes at Subtitle A (Income Taxes), CHAPTER 1 (NORMAL TAXES AND SURTAXES), Subchapter B (Computation of Taxable Income) – specifically Part I where it actually enumerates beyond the inclusive clauses at sections 61-63, income that is includable for tax purposes (the next section also specifically excludes certain income).
I would also again point to the notion that section 61 does not limit compensation for services to those engaged in a trade or business.
Yes, the Title 26 is somewhat convoluted. But, really, read together, it requires a person who receives income (above the exempt amounts) to file a tax return and it specifies that if the tax return shows taxable income, the person receiving the income has to pay it.
In other words, personal liability is set out in the code.
In addition to § 1, § 61, and § 63, take a look at § 6012 and § 6151.

There is no some secret way out. If you want to avoid paying income taxes, repeal the code.
Where is the liability statute?
“Liability for taxation must clearly appear from statute imposing tax” Higley v. Commissioner of Internal Revenue, 69F.2d 160 (1934)
None of the sections you list are liability statutes.
Further, “Gross Income” is a business term. What monies we may receive in exchange for our labor are not business receipts. I, for one, do not have any “gross income”, “net income”, “wages”, etc., and, I am not an “employee” working for an “employer” as those terms are defined in the code.
One may, if one chooses, swear to the money being “Gross Income” and list it as such on a signed under penalty of purjury “return”. One may also call what one receives “wages”. And, again, swear to such money on a “return”.
The code is quite clear regarding the need for a “individual” to self-assess. A “person” may incur any “liability” for anything if one so chooses.
Regardless of the above, once again, a clear and unequivacable statute must impose a liability in order for any of the sections you mention to have any effect on one not volunteering to be a “taxpayer”.
For example: “Every individual (see section xxx for definition of “individual”) working (see section xxx for definition of “working”)in any capacity doing anything (see section xxx for definition of “doing anything”)and getting paid anything (see section xxx for definition of “Paid anything”) of value (see section xxx for definition of “anything of value”), in the United States (see section xxx for definition of “United States”), are hereby liable to pay a tax.
The statute must clearly identify who is taxed and what is taxed. Congress, and thus the IRS, has never defined “income”. The definition of “gross income”, is net minus deductions. But, “income” is not defined. Fortunately the Supreme Court has defined “income”. They say it is “gain” or “increase”.
Congress never imposed a tax upon labor.

The sixteenth amendment, according to the Supreme Court, simply separated the “income” frome the “source”, to eliminate confusion concerning that matter. And yes, once again, labor can be a “source” of income. Just like using a machine as a resource to make a profit, the “labor” of a group of men and woman can also be utilized, with the resulting “income” taxable regardless of its “source”.
Get with it people, this stuff is not difficulat to understand if you lose ythe preconceptions forced upon you since you first started working.

In the courts of this land, unrebutted presumptions can and will get you convicted of all sorts of statutory infractions. It is not the job of the judge to advise the defense on such matters, while few defense attorneys are educated enough to challenge presumptions based upon jurisdiction or the status of the accused.
What follows is my personal affirmation of status. Any proceedings or decisions from the bench which fly in the face of this affirmation, or deny and/or twist due-process rights, can and will open the door for a successful appeal if convicted.
“I deny any presumption that I am a “person liable”, a “person subject”, or a “person required” as those terms are used in 26USC 6001, 6011, and 6012. I further deny any presumption that I am a “person” effectively connected to a “trade or business” activity as a precondition to the filing of information returns per 26 USC 7701(a)(26).
I deny any presumption that I am an “employee” working for an “employer”, as those terms are defined in 26 USC 3401. I further deny that I was the recipient of “wages” as that term is defined in 26 USC 3401 & 3121, or that I earned “income”, as that term is defined by the United States Supreme Court in regards to “income taxes”.
I deny that I am a “U.S. Person” and/or a statutory “Citizen” of the United States, as defined under 8 USC Sec. 1401, and further deny that I am a “Resident” or have a “Domicile” in the District of Columbia, as defined in 26 USC Sec. 7701(b)(1)(A).
I claim Jus Soli (birthright citizenship) and have long since affected a political devorce from the United States Government. Any relationship I may have with the United States Government would be in the character of a “transient foreigner” and/or “American national”.
I deny that I have any contractual aggreements with the United States Government or The Government of the United States of America, Inc.
I deny any presumption that I am subject to the jurisdiction of the United States Government, the executive (President) and executive agencies/departments of the United States Government, and the District Courts of the United States, excepting when and if the aforementioned are acting in a capacity authorized by and clearly delineated in the Constitution for the United States.
I deny that I am subject to any “Special laws” of the United States, that only “Positive laws” with application to the population at large, and listed as such in the Federal Register, may reach and affect my self.

Carl, the question you were asking is about the liability statute. I cited 6151. If you read that one, it uses words like “person” and “shall pay such tax.” A command to pay is a pretty straightforward way of saying “you are liabile to pay.”
As for your other arguments, well, they’ve been out there for a fairly long time. They don’t work very well.

Unless the word “person” is defined and specifically points to a liability statute it does not establish liability. Remember, a corporation is a “person” for legal purposes. This is the reason the Supreme Court stated that a liability must be clearly defined. Lawmakers have been using words which to most people mean one thing. However, when you check the definition for its use in a particular law you may find that it does not “include” everything or everyone you thought it did.
6151 does not fulfill the requirement for a clear and unabiguous liability being attached to all “persons”. Anyone who argues otherwise does not know what they are talking about. Sure, it appears to apply to all “persons”, but we know that is not possible. It is so simple to challenge such a claim. A “persons” status can vary due to geography, citizenship, etc. Nice try, but it does not hold water. The “code” cannot cobble together portions of different statutes and create a new statute from the parts. Title 26 is full of such manuevers. Fortunately, the code has been cracked with the advent of the computer. Liability must be established by statute. There just is no way around it. Void for vagueness has doomed more than one “law”.
Furthermore, just because an “argument” has been “out there for a long time”, does not mean it is without merit. Lower courts, who’s findings are only applicable to the particular case heard, have shot down many “arguments”. Judges have been preventing a fair hearing of the facts for many years. The only decisions which hold any lawful weight are Supreme Court rulings. Tax Courts, District Courts, etc, are administrative bodies i.e. Article IV tribunals, werein the “Judge” can do anything he wants to. Substantive due process is ignored so as to insure “public policy” and the “fisq”
are protected. Not to mention the overpowering need to protect and increase the judges pension. Sir, the corruption of our nations judicial system is bared for all to see. Why do you suppose there is such an uproar on the internet?
Don’t you think the prosecution in the Cryer trial would have argued, as you have, if they believed their argument would not have been torn to shreds by the defense? They did not dare give the truth more of a hearing than it was already getting. They went away with their tails between their butt cracks.

I’ve never paid income taxes in my life and am 50 years old. I heve won against the IRS in thier own office and federal court. I’ve never been in jail on thier trumped up charges which are based on 90% bluff. Wrote a Book in 1988 on how and why I did it, called – “No More Taxes” (self published).
Cryers Memorandum hits the nail on the head in the first part where he mentions that he is exempt by way of the constitution for the united states of america. You remember – don’t you … NO DIRECT TAXES.

This seems by far the most credible debate I’ve read online about Mr. Cryer’s case… Has anyone read or knows where to get the court transcript? Reading between the lines gives me the feeling things got a little heated in the courtroom.
Since I am not as well educated as most of you seem to be… let me see if I got this right…
There is a law that says we have to pay taxes – most specifically under certain conditions such as the example of the employer paying $12/hr and billing $50. – but… and here’s the important part… there isn’t a part of the law that says what the penalty is if little ol’ me – the employee doesn’t pay tax on his hourly wages.
I’m thinking somewhere in those transcripts, somebody must have explained it to that jury in nice simple… maybe even stupid… english.

Good luck with whatever book you’re peddling but keep in mind that promoting the nonpayment of taxes has been equated with abusive tax shelters (in fact, I’m posting about that later today). In other words, it’s very easy for you to anonymously tout your “works” here but far more challenging to sell it on the open market.

I did access the federal courts online and there appears to be no transcript. I did read all of the documents filed online including a bazillion motions to dismiss – they’re pretty interesting, including the official order to give the jury food and drink (!).
The most interesting thing that I found was that Cryer didn’t represent himself throughout the entire proceedings. At some point, he did have counsel.
DOJ attorneys, at the behest of the IRS, have been threatening authors of books about the misapplication of the tax code for many years. However, any book which strictly sticks to the facts, i.e. the law its self, should be secure from prosecution. I say “should”, and not “will”, because the DOJ can often depend upon the judge to prevent the defense from presenting all the facts to the jury. Consequently, the truth is often not allowed a full hearing in our courts.
A reading of the trial transcripts of most of the “wins” against the IRS, usually reveals that the defense was allowed to present to the jury the law and the facts. To counter the defenses presentation, all the prosection has to do is produce the law, the actual statute that the defendant has violated. That’s all folks!
We know, however, that just like this recent trial, when the judge allows discussion of the law (instead of instructing the jury that he, the judge, will rule on the law, while the jury need only rule on the facts) the IRS loses every time. Why? Because there is no law.
I know it is almost impossible for most to accept the fact that they have been lied to by their government all of their working lives. Guess what. That is what governments do. It is time for childhood to end, people. Grow up. Your government has taken your money through fraud. It has conducted itself like low-life hood standing on the street corner picking pockets. It has used threats and thuggery to frighten the population into submission.
A critical mass will soon be reached in this nation, where so many people will be informed of the truth that the government will fall. Congress, and the IRS, have vivid nightmares of the mob climbing the hill with pitchforks in hand.
I urge everyone to study the facts concerning this matter. Your children, and grandchildren, depend upon you. Type such words as “the missapplication of the tax code” or “government jurisdiction and taxing authority” or “supreme court rulings on the 16th amendment”, “Supreme Court defintion of income”, etc. into a search engine. The truth has something that falsehood never will. It is far easier to grasp and understand.

I would suggest starting by scrolling down to Dan Meador. Mr. Meador, and his wife, devoted the majority of their time to unraveling the history of the IRS and the “laws” and legislative history which got us to where we are today (as slaves and subjects, instead of free and sovereign men and woman). A clearer or more complete revelation concerning status and jurisdiction has not been written, as far as I know, and I have been studying this subject for twelve years.
This information will not be found in any curriculum or text book. The colleges and universities of our once great nation do not teach what needs to be known. Orthodoxy controls and dictates what will be imparted to the fresh, young minds of their students. Afterall, government grants, tenure, and cushy retirements are at stake.
A real lover of learning will seek and find the truth outside of the halls of “higher learning”. Yes, it is a great deal of additional work on top of the work your “teachers” will require of you. However, “Ye shall seek the truth, and the truth shall set you free”.
I can attest to the true feeling of liberation that knowledge brings. Childhood ends when a man or woman decides to find out about the world on their own. True adult maturity begins when we finish listening to the voices of others, and start to follow the voice of our own heart and mind. Wisdom must be earned, before it is bestowed upon the seeker.
If the IRS, and its enablers in the academic community, tell you that their is a law which makes you liable, insist that they show it to you. Just make sure, that what they show you is not a portion out of context. Remember, a “code” often has a secret behind it barring full understanding until that secret code is broken. The secrets behind the United States Code are the statutes-at-large. Insist upon seeing the evidence as written in the statutes, not the code. Also, insist upon reading EVERY definition of ALL words used in the text. As you probably already know, a “person” can include a corporation. Another extremely important word to define is “includes”. It does not, in most uses, mean to “expand”. At least, that is what the Supreme Court has said.
Never forget that the United States Constitution is the supreme law of the fifty states, and that the only court whose rulings count is the Supreme Court. Lower court decisions are only applicable to the particular case.
Our republic is taking its last breaths. Its death is very close. The only life that still remains is the animating spirit of an ageing generation. My greatest fear, my constant living nighmare, is that when that generation passes their will be none left to take up the cause of liberty.

i ain’t no lawyer, but i’ve a bit of understanding concerning the IRC. to answer a few questions i’ve read in the comments. to my knowledge, “income” is defined as a undeniable accession of wealth, clearly realized, over which the taxpayer has complete dominion. now, accession means: gain or addition. for income tax purposes, it means, to the best of my knowledge, addition. so if you recieve anything that can be considered “wealth” then you have an accession of wealth. saavy? this means that if you are given a piece of paper, a meal, or even some ‘goodwill’, then you have an accession of wealth. but what is this wealth worth? well, what you pay for it, or it’s fair market value. now, what if you purchase something (a physical object, like a piano) thinking it was a lower value, and then later find out it is a higher value? your cost is still the same, yet you don’t have ‘income’ because, although you have an accession, you have not yet realized the income. it will be realized once you sell it for the higher price. this is called realized gain. and of course, it must be in the exclusive control of the taxpayer. you can’t be taxed for someone else’s income.

This is a bit difficult to follow if you’re not a lawyer, and may seem a bit counterintuitive, but all Cryer’s arguments were rejected by the court. Cryer made tax protester arguments. Those are arguments about what the law is. Had the court agreed with Cryer, his motions would have been sustained, and the case would have never gone to the jury. There would have been no “not guilty” verdict, and thus no verdict at all — just a dismissal. Cryer raised what is known as a Cheek defense — that his conduct was not willful. The jury did not find that the gov’t proved its case. Not guilty. By the way, in response to another writer’s comment, an inheritance IS income. It’s an accession to wealth. And it would be taxable to the recipient under 26 USC 61 — if it were not for 26 USC 102 (which excludes an inheritance from “gross income”). Also, there is some case law to the effect that even if a recovery is not “income”, the Congress can TREAT it as income and tax it as income. Murphy v. Internal Revenue Serv., 2007-2 U.S. Tax Cas. (CCH) paragr. 50,531 (D.C. Cir. 2007). Murphy was not a tax protester case, but Murphy is a tough break for tax protesters (as usual). –Famspear
So, let me get this straight. A “tax protester argument” is an argument about what the law is. Do I have that correct, Famspear?
So, it would follow, then, that anytime the DOJ brings up the subject of the law, the prosecution becomes a ‘tax protester”. Or, is it just when the defense brings up the subject of the law?
Calling someone a “tax protester” because he or she wants to draw attention to what is actually written in the statutes is nothing more than name calling. It prejudices the listener towards the non-government party. As though only the government, and that includes the judge, possess the ability to understand the written word.
Juries, in trials where substantive due process proceeds, are tasked with noticing the law as well as the facts. It is only in trials where administrative due process proceeds, where the judge instructs the jury that he/she will rule on the law, while the jury will rule on the facts.
Title 26 is prima facie evidence of law. It is not so called “positive law”. In our system of legislative rule-making, the following process must be followed if a law passed by the congress is to have application to the general population, i.e. those of us borning and living in one of the fifty states party to the constitution.
1. A Congressional “Bill” is approved. (Article 1, Sec. 8 of the Constitution for the united States of America, limits Congress’s law-making powers in regard to the fifty States)
2. A “Slip Law” is created and numbered.
3. It is recorded in the Statutes-At-Large. (From which the IRC is written is the only real “law” that can be cited as an authority or evidence in tax litigation)
4. It is placed in the United States Code (at which point it becomes Prima Facie, not yet real, evidence of a law)
5. Implementing regulation(s) are created. (If no implementing regulations are created, the “law” cannot be enforced)
6. It is codified in the Federal Register (To have general application a regulation must be published in the Federal Register, per 44 USC Sec. 1501, et seq.)
Title 26 is not “positive law”, it is what is called “special law”. Special law is that creature of the legislature which is applicable to people who are subject to certain liabilities due to their “special” status”. That status could be, for example: a government employee; the officer of a corporation chartered by the United States; a citizen of a United States Territory; etc. Jurisdiction is very much a deciding factor as to whether one is “liable” for “special law”.
Is it any wonder, then, that the tax court and district court judges want to control all discussion about the “law”? The primary task for the defense attorney in a tax trial such as Mr. Cryer’s is to try to get the law entered as evidence.
Yes, “willfullness” is the focus in a willful failure to file trial. However, it is almost impossible to mount a proper defense, that is convince the jury that their is reason to question the prosections contention that the defendant “broke the ‘law”, when the actual law is not given to the jury. The indictment does not even list the statute that was allegedly broken.
Which brings us back the the starting point. That is, that if the DOJ/IRS wanted to convict Mr. Cryer, all they had to do was show the jury that he was selective in his reading of the law, by show the jury the law. They were not capable of doing that, because THERE IS NO LAW.
Mr. McCoy, according to your hypothesis there are tons of laws requiring you to pay income tax, but there are also tons of exeptions to paying certain income taxes.

I ran a search and found over 40 new regs for the 2007 publication alone that refer to paying income tax, IRS regs, etc.
While I agree that the income tax system is immanently unfair, I don’t think that denying the obvious fact that there is a law is the proper way of rectifying the unfairness.
I am more apt to follow the line of thinking that (1) there is a valid problem (unjust, extant law), (2) there are means to rectify the problem (constitutional amendment, executive order, congressional action, etc.), and (3) certain means, when affected, shall resolve the issue (I’m partial to Ron Paul, but I also like to consider myself a realist).
Debating the obvious is not a workable strategy.

All IRS apologists commenting within this blog have so far failed to disprove the main point of the discussion. Is there or is there not a statutory liability which obligates an average worker to pay a tax measured by the amount of money he or she receives from the “privilege” of working? Or, does the liability/obligation arise when the worker confesses to “gross income”, and thus “taxable income” on a 1040 form.
It should be an easy task to show such a statutory liability if it does indeed exist. It seems the DOJ attorneys had a bit of difficulty finding it.
One’s status (ex.employment; citizenship), and the “source” of one’s “income” (ex. foreign derivation) plays an important role in establishing
whether or not one has received “gross income”.
Another interesting issue is whether or not the “income tax” forced down the throats of Americans is a direct or indirect (excise) tax.
Has anyone read Cryer’s Memorandum? Where are all the “experts”? Doesn’t anyone want to challenge his reasoning? Could it be we all agree with his presentation?
I have read it, and I agree with his contentions 100%. I, for one, would be quite concerned for my reputation as a scholar if I tried to rebut his evidence. I know how easy it is to just call it “frivoulous” and contend that this or that lower court has denied it legitamacy. Unfortunately, it does not matter one twit what some lower court believes. Judges have been cowering down to the IRS/DOJ long enough. It is time they show some balls and self respect.
So many are so quick to denounce anyone challengeing the institutional paradigm of the “income tax”. So many will go on about how the law says this or the law says that, without ever quoting the actual law. I understand how many cushy government jobs and hard-earned academic positions are jeopardized by the growing knowledge that we have all been fooled into giving a substantial portion of our life earnings to the government. This is one of the most terrifying conversations I have ever read. I’m trying to determine what to print in my newspaper, I’m the editor, and I’m absolutely terrified.
On the one hand, there appear to be easily defensible opinions on both sides. On the other, it appears that the law, at root, is quantum, that is: it is what you see it as.
No matter how hard you try to force the quantum “law” to materialize in some undeniable form, other observers can apparently reduce it to quantum uncertainty and rematerialize it in another form altogether, leading us to the painful conclusion that the ultimate determination of what the “law” says is based on who has the most “quantum power” to determine the largest share of interpretations, namely, what agency is “sovereign” in the land.
Ultimately, the sovereign of any nation makes the decision about what the “law” is. George Bush has demonstrated that he feels that’s the way it is on many occasions. It also makes the decision about what the “interpretation” or “nature” or even moral reasons for the law are.
In a land that was founded on popular sovereignty, where the government was granted certain powers with extreme hesitance by the people, I do tend to feel that despite the apparent legitimacy of the laws quoted by tax lawyers, the IRS and the Federal Government, at root, the intention of the founders was probably to protect the people from many of the types of taxation that are currently levied, including the taxation of labor.
Legally, this argument tends to come down to what the 16th Amendment confers to the government. “Tax protesters” regularly quote the Supreme Court decision stating that the 16th amendment gave the government no new powers of taxation. Why would the Supreme Court rule this way if there were some question about it? What was the question that the Supreme Court was answering? It must have been important. Has that Supreme Court ruling ever been overruled or superseded?
Unfortunately, common understanding of the nature of sovereignty and rights is so nearly gone in America that Mr. McCoy’s concerns can only be considered reasonable. I hope he will submit a 1200 word overview of the case and context for publication. Perhaps Kelly the Tax Girl would like to submit a similar brief.

I’ve read all the comments here, including Kelly’s and Carl’s well thought out, reasoned arguments, and I’m still confused, and I haven’t been able to find much of anything regarding court documents online – all I’ve been able to find is “this is what the court said” sort of stuff. I’m not interested in reading “Cryer’s Memorandum” or what the IRS or DOJ filed – it doesn’t matter what arguments either side put forth – I’m interested in hearing exactly what the court had to say in it’s ruling – that’s what matters.
If Mr. Cryer was indeed found “not guilty”, what was the basis for the verdict? If it was as stated above, that the IRS/DOJ didn’t prove that Mr. Cryer knew that he had to pay tax but wilfully failed to, then it doesn’t seem as if Mr. Cryer has a leg to stand on, so to speak – the case wasn’t about whether or not “income” was what Mr. Cryer or the IRS claimed it is, or who owes who what, but it was purely about whether or not Mr. Cryer was guilty of wilfully failing to pay tax he knew he was liable for. As such, the underlying issues about income and such as posed by Mr. McCoy above weren’t addressed and still remain open. As far as I’ve been able to determine, Mr. Cryer is still legally liable to pay the $73,000 in taxes the IRS says he’s liable for, and he’s still liable for failing to file income tax returns – the court didn’t say anything at all about that. If I’m wrong, would someone please point me to the relevant court documents?
Despite all the ballyhoo on both sides of the issue, no one’s been able to point to a *specific* case ruling on the issues at hand, just cases touching on inference and speculation about what the case really meant. So, Mr. Cryer’s “victory” really means nothing at all in regards to the underlying questions.
That’s unfortunate – it would really be nice if a Federal court judge had the stones to say, “hey, tax protesters, IRS, come get some – lay it all out, and we’ll rule on all of this stuff, once and for all, clearly and unambiguously ruling on each and every point that both sides present, and put this issue to rest.” But I guess that’s wishful thinking – I get irritated at case after case decided on by the USSC that says that either “you didn’t bring it up, so even though it’s relevant, we’re not addressing it” or “we’re just not going to address that issue”. The Justices that decided fundamental issues at law – Marbury vs. Madison, Miranda vs. Arizona, Escobedo vs. Illinois – are long gone, it seems, in favor of judges that issue rulings drawn as narrowly as possible. It seems if they could, judges would issue rulings that said explicitly “this ruling applies to this case specifically and no other”. The state of jurisprudence in this country is very sad.

It is true that Attorney Cryer was found by a jury to be not guilty of willfully failing to file. In order for “willfulness” to be proven, the IRS/DOJ would have to prove that Attorney Cryer knew he had a lawful obligation to file and yet did not. The defense convinced the jury that Attorney Cryer truthfully believed that he was not lawfully required to file, because he truthfully believed that his “income” was not taxable under the Constitution and Title 26.
What often happens when a defendant is acquitted of the charge of willful failure to file, the IRS/DOJ go after them in a civil proceding. Whether that will happen in this case I do not know.
It is, however, important to understand the underlying issue of whether or not most of us receiving money for performing work in what is called “occupations of common right” are liable per the Constitution and the laws written to effect the will of Congress. The Cryer case did not “prove” this one way or the other. And, as you cover in your recent post, no court decision seems to have directly addressed this issue so as to settle it once and for all.
No court in this nation will ever voluntarily rule on the legality of forcing payment of taxes as tribute for working in an occupation of common right. The courts and judges therein will not allow the law to be discussed in detail, and the judges will go so far as to deny the defense their due-process rights during trial. A recent example of this was the prosecution of the Brown’s in New Hampshire.
The jury in Attorney Cryer’s trial read his Memordandum. I have read the Memorandum, and find it to be more than sufficient to settle the legal issue of whether or not Congress has caused laws to be written requiring the average man or woman to pay tribute from the money they receive working in occupations of common right. I challenge any attorney, judge, IRS official, etc. to debate the facts within the Memorandum. They never will because they are cowards of the first magnitude.
The ‘We The People’ foundation challenged Congress, and most recently the Supreme Court, to debate the points raised by Attorney Cryer, and they refused. Why? Because they know the truth. They also know that they would be forced to admit that the people of this nation have been forced to pay a direct tax on their labor, without any liability for that tax being imposed by by Congress.
You wrote that if they could, judges “would issue rulings that said explicitly “this ruling applies to this case specifically and no other”. Judges do issue rulings with written restrictions attached. The deciding judge will mark the transcript such that it is not to be quoted as “case law” in any other proceeding. This happens all the time.
You mention that you only give credence to court-issued documents, decisions, etc. The IRS is famous for quoting decisions reached by lower courts, but seldom if ever quote Supreme Court Decisions. The IRS’s handbook admits that lower court rulings are to be regarded as applicable ONLY to the case wherein the decision was reached. Lower court rulings are NOT to be used to support any IRS arguments against other cases. This rule, however, is regularly broken.
I suggest that anyone waiting to hear an honest and open debate within a court of law concerning these issues will wait in vain. The judges simply will not allow it to happen.The only forum where the issue is being debated in an honest, full, and open manner is on the internet. Reading Attorney Cryer’s Memorandum is a good place to start one’s education.
I cannot understand why any seeker of truth would insist upon that truth being forthcoming only from “authoritative” sources. We must forever be aware that those with vested interests, those with a great need to maintain the status quo and their own personal paradigm, will resist the truth, distort the truth, and finally prevent the truth from being heard entirely. Leland, his is the condition we are faced with today.
Understanding the history of taxation in America can and will take years of study. Most people cannot afford the investment in time and intellect that such an endeavor would require. That is why we have “specialists” and “experts”, they say, who’s job it is to tell us what the truth really is. Well, the specialists and experts have gone over to the dark side. They know who provides their bread and butter, and they are not about to antagonize their master. They are compromised and thus they cannot be trusted. It is up to each one of us to ascertain the truth. It is up to each one of us, if we care, to exert the effort required to understand what is really required of us per the law. The only alternative for the ignorant is to continue to sheepishly pay tribute to their government masters.

In the united States called “America”, the people gave their consent and recorded it as such in their ‘Constitution for the united States of America’. Art. 1, Sections 2, 8, & 9 of that document contain the taxing clauses, listing two, and only two, types of taxes which may be levied by the Federal Government for revenue. All taxes must fall within what has been termed the “two great taxing clauses” . They are “Direct Taxes” and “Indirect Taxes”.
Direct taxes are imposed upon the property of a man or woman, and are paid directly by the man or woman to the taxing authority. Indirect taxes, also called excise taxes, usually entail the use of a “middleman” for collection, as happens when you buy gasolene or alcohol. Excise taxes can also be imposed upon certain privileged activities.
The Constitution binds the Federal Government as far as the levying and collection of Direct taxes from the property of the citizens residing in one of the 50 States. The Constitution requires that Direct taxes be apportioned amoung the 50 States. That means the Federal Government must engage the governments of the 50 States to collect that revenue.
Most people, and especially the IRS, DOJ, judges, and H&R Block, like to believe that the 16th Amendment to the Constitution relieved the Federal Government of that burden. However, that is simply not true. The Supreme Court said in Staton v. Baltic Mining Co., 240 U.S. 103 (1916) “The provisions of the Sixteenth Amendment conferred no new power of taxation”.
Other Supreme Court rulings have reiterated this fact.
We have witnessed numerous IRS officials, judges in federal court, university professors, and editors of newspapers insist that the 16th Amendment changed the Constitution such that a man or woman’s labor in an occupation of common right was now directly taxable by the Federal Government. Anyone supporting this contention is either profoundly ignorant or a liar.’
(I so wish before I die that I read in a newspaper an editorial opinion that includes calling some government official or judge a liar.)
Attorney Tom Cryer was acquitted. Why was he acquited? The jury listened as the defense challenged the IRS/DOJ to produce the law that Attorney Cryer had broken. They could not. How much clearer can that be? Why the need for judicial comment upon the obvious?
Leland, I take exception to your characterizing the scholarship of the tax honesty movement as so much “ballyhoo”. Your refusal to read Attorney Cryer’s Memorandum, coupled with your insistance that only court rulings contain legitimate facts and truths concerning the law, do not reflect well upon the character of your intellect. I urge you to reconsider the postion you have taken. As an editor you owe it to your readers to present the facts in this debate.
Newspaper editors must have the “stones” to present the material in an unbiased manner and let the reader draw their own conclusions. As an institution, the newspaper industry has shown itself to be firmly in the grasp of the government when it comes to presenting the facts. I cannot ever remember reading an article where the paper has presented evidence of a judge trampling the due-process rights of a defendant. That same paper will, however, highlight the “learned” decision of that same judge when he punishes an innocent man or woman.
In conclusion I must again impress upon all men and woman to take the time and expend the effort to learn the truth for themselves. That is the only manner in which this beast can be subdued and liberty returned to our land. The courts and their judges are bought and paid for. Look not to them for the answers.

Yes. I believe their is a book titled ‘The Law That Never Was’, which leaves the reader with no doubt of the fact that the required number of States did not lawfully ratify the Amendment. For example, some states re-wrote the language of the Amendment, effectively nullifying their ratification. The Secretary of State at the time, Cox, on the floor of the house stated: “Apparently the Amendment has passed (or words to that effect) What did he mean by “Apparently”? It either did or did not.
The Sixteenth Amendment, lawfully passed or not, really has no bearing upon whether or not the money received by a man or women engaged in an occupation of common right is subject to a direct tax. The authors of the 16th Amendment never intended it to affect the property of that class of American (See the Congressional record for legislative intent in the passing of the 16th Amendment).
The IRS/DOJ, along with a compliant judiciary, have used public ignorance of history to convince people that what was once not allowed by the Constitution was now allowable due to the passage of the 16th Amendment. We now know they were spreading a falsehood, (LIES), and they continue to lie up to the present.
I imagine it will not be too much longer before a critical mass of Americans know what we are writing about, much to the detriment to government employees (and H&R Block). I would not want to be an employee of the IRS when that critical mass reaches the boiling point. I see necks stretched from lamp posts up and down Pennsylvania Avenue.
